California Condom "Crime" Commences

It is now illegal to remove a condom from your penis without the consent of your sex partner! Good luck enforcing that! Can you imagine telling a jury that in the heat of sex your partner ripped the condom off and shot a load into your butt?

"California became the first state to make stealthing, the act of removing a condom without consent during intercourse, illegal after Gov. Gavin Newsom signed a bill into law on Thursday.

The bill amends the state’s civil definition of sexual battery, making stealthing a civil offense and giving victims the grounds to sue their assailants for damages."

(I used the word "crime" in the title because of the alliteration effect. Technically, this has been made a civil violation, not criminal.)

This should be illegal everywhere.  Barebacking someone without their knowledge/consent is reprehensible.  If both parties agree during the heat of passion to remove the condom, that's entirely different.  But a top deciding he wants to remove the condom and doing so without the knowledge of his partner is just wrong on so many levels.

Granted it should be illegal, but enforcement is altogether another issue. It would be one person's word* against another, and it would involve discussion of pretty personal information. I don't see the law as being very effective.

 

*Absent disease transmission which could be proven.

How many have caught your partners trying to do this? I imagine this must be pretty shocking. I wonder if one could take an escort to court?

That doesn’t prove anything….

Condoms aren’t 100% effective at preventing any disease.
Condoms break.
The "insertee" (for lack of a better term) can also stealthily remove a condom…been there.
People lie….on both sides of this equation. 

Like most of California…the Law is well intentioned, and stupid.

Considering the culture of rape all over the country we have bigger things to face.

Governor Newsom has had a great legislative month.  He has signed bills to: 1) make stealthing illegal. 2.) make all high schools provide female students with FREE sanitary items. 3.) make marital rape the same as regular rape. and 4.) make it a requirement by 2029 that all high school graduates must have taken a class in ethnic studies.

The first time I was filmed during sex, my partner did this to me.  He also didn't tell me he was filming. But the video was hot 🔥 so I let it go

It is one thing to remove a condom and continue with sexual penetration of any form without your partners permission, but as I naively read it I took it to mean you shot, you're done, you're soft and it's sliding off.  You just want to embrace and not have it spill all over the place because you partner is not interested taking it to  drip the cum into his mouth.   Do you really have to ask then?  Are you responsible to prevent it sliding off then also?  

Reminds me of a case where the guy was using a condom for birth control.  The girl "got rid of it" and then used it to get herself pregnant.  Guy was on the hook for paternity none the less.  Is that illegal in CA also?   Or are we still on that one way street?

School nurses’ offices have long provided them for free. Such items can be expensive and an inability to access them can make it difficult to concentrate on learning. They provide free lunches for the same reason.

Yikes! Did the woman admit to it? If so, I would think that would constitute fraud, and he'd be off the hook. It sounds pretty outrageous.
