I would think this defendant's activities have rendered very clear indications of that inability, however, I am not credentialed for an official determination.

There's still a chance of a jury trial.  If the U.S. Attorney's office presses for a deal harsher than he might get from a jury and judge, the defense might roll the dice.  Not highly likely, but still possible.

Of course, thinking a jury and judge will have even an iota of sympathy for a guy who conspired with a father to have sex with his seven-year-old son is a stretch, assuming the evidence of that incident comes in.

Yeah, unless the most damning evidence we've read about isn't allowed to come in during a trial, there's no way he'd get a better outcome with a jury.

He has all the redeeming factors that will net him the worst possible outcome in a jury trial. Middle-aged-wealthy and gay white dude preying on kids for sex. Only reason for a jury trial is if he didn't know their ages. That and I'm sure his lawyer will just play up the hear say aspect.

That defence doesn’t really get you out of jail. If found criminally insane (not the actual  term used today) you go away forever in a suitable facility with the other criminally insane, some of whom can be really scary ( as in be Silence of the Lambs crazy) .

After writing this I remembered a case where a guy decapitated another guy sleeping on a bus in Canada somewhere. He was found not responsible by being criminally insane. Then years later he was let out. Caused an uproar at the time.

Who would pay for that? Does Austin have deep pockets? A wealthy benefactor willing to support him? So few cases go to a jury, and it's mostly a cost-savings issue in a very backed-up system. Unless the guy is innocent, what would be the point of a jury trial?

Austin Wolf celebrated his 44th birthday (born April 3, 1981) last week in a jail cell in Brooklyn. My, how the mighty have fallen 😧. 

For his sake, Bozo hopes that he's been saving the shekels he's earned in his 20+ years in the business. A good law firm doesn't work cheap. Given Wolf's celebrity status and the nature of these horrific (alleged) crimes, he had better hire one of the best.

As horrifying as the case against Justin is...the fact that a father of a child went THAT dark with HIS OWN child is a level of depravity that is just unfathomable. $850-1K a hour is the norm for an attorney who can broker a deal like this.

I can't wait till all this is over and we can see what millions will buy you with today's Justice. Plus, he'll get some kind of plea agreement because he's working with authorities to bring down others in his network. I can't say as I don't blame him though.
