This is what the judge concluded: "So I have spent some time reading the submissions in this, and I'm -- my take on it -- and you can correct me if I’m wrong -- is that this Defendant doesn't have a problem with children, with exploitation of children, with child pornography. He has a -- somewhat of a drug problem. I would say minor but one that has to be addressed. But he doesn’t have -- it is a total misfit to treat him as a sex offender. It is a total misfit." and "I have been a judge for 21 years, and I have never seen this offense charged....This case is about what steps he took in order to conceal the [boyfriend's] offense, and he did take some steps. And they are not disputed. And what he did was wrong. And now he has been convicted of it. He pled guilty and he has been convicted of it, but that doesn't make him a sex offender."
