Hey guys, so I don't post much, but I've enjoyed the wisdom offered from this forum for years. I have a question.

I've been visiting a local escort about once a month for going on three years now. He's not discussed on here, he was a rare craigslist find back when my area didn't have much to offer. We've actually become pretty good friends, and I've actually played with him and his boyfriend a few times since they got together around a year ago.

His bf texted me and warned me not to send any explicit texts because his bf had been arrested for prostitution.

That got me worried. We have been texting for three year now discussing appointments, sexual activities, and money. If the police search his phone, and those texts are on there, am I in trouble?

Potentially, yes. First of all, jurisdictions vary in whether they go after clients as opposed to the provider. Many don't. If your jurisdiction does, then you may have a problem. It depends on whether he kept the texts, or, if he hasn't, whether the prosecutor subpoenas them from the provider.

Don't panic. Probably nothing will come of it, unless he was involved in some other violation of the law that warrants a wider investigation of his activities. But if you want additional peace of mind, go to an attorney, pay him for an hour of his time, tell him your story, then if the police contact you, refrain from making any comment to them until you consult with your attorney.

I doubt the cops would go that far, unless there were more serious crimes to this guy besides the prostitution charge. What State are you in, if I may ask.

I guess it is theoretically possible that the police might question you, but it seems like "johns" are almost always caught "in flagrante delicto," that is, caught red-handed in a sting à la Chris Hanson. As E.T. Bass indicates, spending time trying to connect you to a likely misdemeanor criminal act would be a waste of most big city's policing time and effort. Your friend likely was caught making a direct offer of sex to an undercover officer, thus not needing your testimony. However, the BF gave you wise advice not to send any further incriminating texts to your friend as authorities may have his cell phone.

I wouldn't worry about it. It might be a good idea to delete all the texts though.

 

As you should know by now text messages, emails, etc. just can't be deleted. If there's a will there's a way to find them.

Can you share any other details to warn other clients and escorts?

 

Not knowing anything about the charges i'd still expect that you are small potatoes to the police.

 

In theory male prostitution is always a non issue. Every now and then someone posts something he heard but because of privacy can't give any useful information because the escort told him...

The first thing I would do is look for the charges filed against him because it seems very unlikely that is the only reason he was arrested. Jail bookings and arrest records are public information (and frequently published broadly) and list the charges. Assuming he really was arrested (and it’s not just made up by the BF) it seems likely that some other accusation would be primary.

 

If “prostitution” is the only charge, with nothing else, then I still wouldn’t worry. What evidence could possibly exist that would implicate you that wouldn’t get laughed out of court. I’d assert that his texts were completely fabricated, even if he did incriminate himself for some reason.

If he says the texts are real and contain your full legal name, address and date of birth then I’d threaten to file a defamation suit.

Short answer = don’t worry.

Not always, I recall a frequent poster making a similar statement about a friend caught in Honolulu and unable to provide any basic information because he was sworn to secrecy...

I guess Utah considering that's were the OP lives and the fact that they get together often.

 

@marylander1940 ..... Once deleted from the phone, it is much more difficult to get a search warrant and serve your provider for text messages FYI.

 

Unless there’s interest, money and manpower.

 

Don’t believe everything Michael Cohen told you last time you got into trouble... ;)

Exactly it’s a very difficult subject and without basic information or at least a link there’s no way to corroborate.

 

There was a similar story about the same happening in Pittsburgh and an escort who used to post on here canceled a trip there. He allegedly got some verifiable evidence by p.m. unfortunately he was also sworn to secrecy by the OP omertà style and was unable to share it with us.

This is all the more reason why a burner phone is a good investment for clients. I bought mine with cash and reload it with prepaid cards I buy with cash. This burner doesn’t have anything that connects it to me.

How do you get a "burner phone"? I have a "private" phone but I needed a SIM card and bought that from T Mobile and it needs to be refilled occasionally. that required me to be identified. Where does one buy a burner phone that does not require id ? Thanks.

Just be aware that text messages themselves are not proof that anything went on and without a direct witness, no criminal charges are going to be levied, Now if you are a high profile individual, a celebrity or a politician, then just having texts on his phone could get you convicted in the court of public opinion, as these things have a way of slipping out. But if you are just a regular Joe Blow, I would not give it a second thought. I would look for another regular though.

@cooperfun if you live in a small town in Utah where nothing ever happens and where there is no escort scene to speak of, a salacious incident like the one you described could be a BIG DEAL. Which is why your escort was arrested. The prosecutors and the cops don't have much else to do. What if your escort, as part of a plea agreement, discloses his clients - including you? By all means, do speak with a lawyer. If you can afford paying for escorts, you can afford a lawyer.

 

For future reference - sending messages containing payment information and explicit descriptions of services to be rendered for these payments is a really BAD IDEA. Just don't do it. If you need make requests of an explicit nature, talk on the phone. As others have observed, you can't really delete text messages.

 

If anything, I hope this was a learning experience for you.
