May 9, 2005 -- A high-end Chelsea gym has been slapped with a $25,000 lawsuit claiming that gay sex is rampant in the locker room and that the club's staff has been unable to stop the steamy high jinks.

 

Carlos Sosa, 34, of Manhattan says he expected the posh David Barton Gym on West 23rd Street to be the normal exercise center its management says it is.

 

But he says he was shocked to see men performing sex acts on each other in the shower, ogling him in the locker room and leering at him as he changed clothes.

 

"The gym misrepresented what they are all about," said Sosa's lawyer, Brian Kennedy. "They represented themselves as a serious place where you actually work out — but it became a saucy steam room that reminds me of the ancient Roman baths."

 

The David Barton Gym was hailed as one of the city's hottest new workout centers when it opened last year in a building that had housed the YMCA that reputedly inspired the famous Village People gay anthem.

 

"They needed a security guard to monitor the showers, the locker room and the steam room," Sosa told The Post. "If that's not peculiar, I don't know what is."

 

A lawyer for David Barton, Tom Shanahan, blasted the suit as "frivolous and without merit" and said his client runs a clean establishment.

 

Matt Dillon, Susan Sarandon, Calvin Klein have all been spotted at the upscale gyms run by Barton, who is married to socialite Suzanne Bartsch.

 

Sosa claims he first noticed the sexual frolicking in November, a few weeks after he started exercising at the gym, which charged him a $950 membership fee.

 

He said that one day, as he was walking into the shower area, he spotted an employee calling out to someone in a stall. He said he saw men getting it on through a gap between two stalls.

 

"These guys were doing something to each other," he said. "You could see it in silhouette."

 

Sosa said he was so disturbed by the experience — and other times when men came on to him — he was afraid to use gym amenities such as the steam room. He claimed he saw gym employees trying to stop the shenanigans, but said their efforts were ineffectual.

 

"Now I'm really uncomfortable, and I'm paying for this," he said. "I felt I had to [avoid the steam room] because God knows if I'll step on something I don't want to step on."

 

He claims the last straw came in January, when a man approached him the locker room while it was empty, sat uncomfortably close to him and leered at him.

 

Sosa claims he soon asked to be let out of his gym contract but was refused. He said that after several attempts to work out the matter, he decided to bring the civil suit, which was filed in Manhattan last week.

 

Barton spokeswoman Diane Briskin said the gym does not allow sexual activity, which is a violation of city health codes.

 

"The membership contract clearly states that such behavior is not tolerated," she said.

 

Sosa is seeking his membership fee back, and $25,000 for emotional distress.

Let's see. You join a gym in Chelsea...that's housed in a YMCA...where Calvin Klein works out...and you're caught off guard by the fact that guys are getting it on in the steam room and showers.

 

That's why they have gyms on the upper east side. So people like Carlos can go there and feel comfortable.

 

Several years ago, while I was a member of the gym on top of the Marriott at the World Trade Center, some guy kept lifting up his towel in the sauna and showing me his equipment. i told him, "Honey, the hets around here aren't going to stand for that kind of behavior. You need to go join the New York Sports Club at 23rd and 8th. You can get all you want there and not have to sneak around about it."

 

Matt Dillon? I had no idea!! I wish I'd known that 25 years ago!

Just another case of some liberal, ambulance chasing trial lawyer sueing some legitimate business.

It will cost the gym about $75,000 to $1100,000 to defend itself

and ofcourse the costs will have to be passed along ultimately to the members of the gym

When businesses are faced with ridiculous lawsuits, we as consumers

end up paying the bill.

While this is really stupid, what troubling is that you have this guy essentially suing because he saw gay sex, and was hit on by a gay man. It's a fucking gay gym. Scary, this is what New York is coming to. The fact that someone actually feels they even have a case here is a little frightening.

 

The steam room has been closed for a month now, something about the building code.

 

My guess is that it will be thrown out. The guy said himself that the gym had monitors walking around. What more responsibility can the gym have? Not to mention that they had another media event recently for throwing a guy out for having sex in the showers, so they are clearly doing what they are supposed to.

 

Personnally, I would have revoked his membership and threw his ass out on the first complaint. Its a private club, they can do what they want.

 

As far as the cost, gyms carry hefty insurance for just such an occasion.

Yes Jake, the gym probably has hefty insurance, but who eventually pays for the hefty premiums the gym pays for this insurance.....

the gym members do ofcourse...

 

Just saw an interesting statistic by the California State Chamber of Commerce..... for every $10 California residents pay for health care ( doctors fees, hospital costs, lab costs, etc) $1.50 goes to pay liability insurance premiums. I imagine it's similiar in New York.

It's really amazing what a low opinion you and the other people in this thread seem to have of gay people.

 

You're all essentially saying that the guy who joined this gym was an idiot for not realizing that there'd be all kinds of public fucking going on in what is supposed to be a gym because, after all, he had to have known that gay men would be at this gym, and everyone knows that wherever gay men go, they run around indiscriminately fucking each other in public, even in places that aren't meant for that.

 

Is that really what you think about gay people? That wherever they go, you have to expect them to be humping like rats, because that's just how they are?

 

Isn't that exactly the argument made to keep gay people out of the military - that they can't be trusted to be in such a sensitive setting because everyone knows that homos can't help but fuck whatever they see, no matter where they are?

 

If I pay money to join what is supposed to be a gym, I don't expect it be turned into a bathhouse, EVEN IF I know that there will be gay men who will likely frequent the gym. That's because I don't view gay men as sexually depraved rabbits who can't be trusted to refrain from fucking in public.

For once, I am in 100% agreement with Doug. The steam room at the Chelsea NYSC was full of sex, but also full of flying cum and dirty seating. Have you EVER seen a guy wipe up his come after shooting off in the steam room? Neither have I and I don't want to sit in it, stand on it, or get hit by it.

 

Steam rooms serve a healthful purpose and for gay men to assume that everybody there wants to see them play peeky peeky with their towels is insane.

No, most of us just seem to have had a lot more fun as gay men than you (and a couple of other posters) have!!! :-( Including at our gyms! We also don't think gay sex is, you know, icky. And we're not especially shocked when we see it happening before us in gay venues. Of course, most of us (at least those of us from sexually benighted countries like the U.S) have pretty much been sexual outlaws most of our lives, so we're not easily thrown for a loop by such revelations. I don't actually think my new best friend, Doug69, was REALLY "shocked, shocked" by this, either!

 

But how stupid could the gym managment be? They obviously know there's physical activity going on of the kind that doesn't involve Nautilus machines. The guy told them he wasn't comfortable with that and asked for his money back. So give him his money back, have him sign for the refund in full, and end of problem!!! Now they've got a lawsuit on their hands because they were too fucking cheap to return the money of a dissatisfied customer. For THAT I think they deserve the lawsuit! I realize this is Chelsea we're talking about, where attitude is de rigueur, so I can just imagine the reaction when this shnook asked for his money back. But when you let it take over to the point where it's going to cost your business big, big bucks it's time to remove your head from your asshole and have it seriously examined!

Why? If it had been my business I'd have refunded the guy's money and that would have been the end of it. Instead, "David Barton" has a lawsuit and his business's reputation splashed across the newspapers. Of course, there's no such thing as bad publicity -- for every squeamish closet case who wants his money back there are plenty of guys who'll decide this is JUST the reason they needed for signing up at this gym!!! ;) And "David Barton" will be giggling all the way to the bank!

You know what, I'm changing my response. I realize now that alot of the guys on this board are just not very interesting. In fact, there's just alot of judgmental assholes around, especially considering this is a board on a website for hiring escorts. Well, OF COURSE! EVERYONE KNOWS! Everyone should be held to know that!

You're ignoring one simple fact: sex there is prohibited by statute. People may KNOW that the 2d floor restroom at Bloomingdale's is cruisy, but that doesn't make the sex that takes place there any more lawful.

Or, he should have contacted the police & the health department, gotten the place raided, the people caught in flagrante delicto arrested, and the place shut down for health code violations.

I believe he asked for his money back, and was refused.

Do you know the FIRST THING about Louisiana law? I'd guess no. Here's a clue: "escorting" isn't to be found in the criminal code--ANYWHERE! If you can cite a single statute I've violated, and can prove I've violated it, I'd love to hear about it.
