There are two constitutional issues: 1) The ex post facto provision which makes one liable for infractions in the past. This is clearly unconstitutional and DOJ has even said so. I doubt it would take the whole law down and, if so, it would be repassed quickly. 2) The possible violation of 1st Amendment free speech. This is harder and in this case it may be good that we have a wack-job Supreme Court that says "money is speech", etc. (I personally wouldn't count on this). Whether an appeal can be done quickly is the issue. I would assume a court will put enforcement of the law on hold pending appeal. However, if it takes time the platforms and providers will already have put serious broad blocks in place and I doubt they will take them down.
