    YES ...this is indeed a Federal case, subject to specific Federal sentencing guidelines. However, the Judge has latitude to which upper and lower range of those guidelines he opts to sentence someone like POS Wolfe. AND there are clear researchable studies out there which factually confirm that in Liberal / Blue States like NY and California, Federal Judges tend to sentence criminals for these Federal felony child porn crimes at the HIGHER end end of the national Federal guidelines!

While we'll find out the specific prison sentence later next month, from my own research it would be highly unusual for the judge to impose a life sentence > so assuming he very likely sticks within the Federal sentencing guidelines, my own prediction be 13.5 years + 5 years supervised probation > 85% of that 13.5 year / 162 month Federal sentence must be served before parole eligibility which would potentially reduce it to 138 months / 11.5 years MINUS roughly 15 months already served (June/2024-Sept 2025) > Meaning he'll be required to still serve a minimum 123 months behind bars / 10.3 years + 5 years supervised probation upon release > Any thoughts / counter-sentence predictions? THANKS again for your highly informative first-hand reporting!

    The judge will very likely sentence him within the guidelines barring some sort of extraordinary mitigating factor. If he goes below or above the guidelines then it's almost an automatic appeal from either the prosecution or defense.

    Ok, so I undertook specific research on the "Federal Plea Bargains Process In The State of New York", with a focus on felony child pornography / sex with a minor criminal charges. Quite correct that the sentencing Judges are not legally required to stay within the specific plea deal minimum/maximum Federal prison term brought before them. However, it is also correct to state that in the very large majority of cases, they do stay within these plea deal sentencing ranges, rarely going below the minimum sentence unless there are "exceptional mitigating circumstances". Factually, 97% of all Federal cases are pled out through these deals, so in order to protect the integrity of this process for both sides, sentencing Judges overwhelmingly do follow the agreed upon plea deal minimum/maximum prison term numbers

    Appreciate this follow-up information "Sir" > thanks again for sharing! "Mr Bozo" and yourself have hands-down provided the BEST information regarding this specific case! My own confusion stems from reading he agreed to a plea deal involving "minimum 10 years to life" > so it would never occur to me that any Federal Judge could actually go lower than 10 years when he announces his actual sentence later next month > minus time served + fines + 5 years probation after serving his time

    His porn name is Andrew Green, but his career lasted only a few forgettable videos before the pandemic. He lives in Terrebonne which is an hour drive from downtown Montreal.     OK > ONE final time for the HARD OF THINKING!:( Please really really really read this carefully and in a totally sober frame of mind > FEDERAL COURT maximum and minimum sentencing guidelines DO NOT vary from State to State > HOWEVER, FEDERAL Court judges in each separate State DO have latitude and discretion in applying those uniform maximum and minimum sentencing guideline ranges > AND GUESS WHAT CUPCAKE?? It turns out that in STATES which have the toughest STATE prison sentences for child porn crimes, FEDERAL COURT judges in those specific States with the toughest STATE penalties, actually DO tend use their LATITITUDE & DISCRETION to sentence criminals charged with felony child porn charges to the MAXIMUM higher range of those uniform FEDERAL sentencing guidelines! > LOL...is this really such a difficult point to grasp intellectually??:):)

    LOL > but as I'm sure you know very well, FEDERAL Court sentencing can and most certainly does vary from STATE to State > so it is deadly relevant to point out that NEW YORK STATE has some of the harshest prison sentences for FELONY Child Porn charges. Thanks for pointing that out!:)

    "Austin Wolf" has been charged in NY with two FEDERAL felony counts of possession and the far more serious charge of possession > hundreds of images and videos. some of which involve children under 12 being brutally raped which is MAJOR serious mitigating factor
    New York has some of the most severe minimum prison sentencing guidelines in the entire USA for child pornography
    There have now been 6+ continuances granted by various Judges so far since Wolf's arrest last June, as both sides continue ostensibly to discuss a possible plea deal > not surprising at all since the vast majority of Federal child pornography cases are settled out of Court
    BUT > you can bet IF the current "plea deal" on the table was half-way decent, Wolf's lawyers would've recommended he take it! The Feds obviously have a rock-solid case against this scum-bag and aren't offering him an such sweet plea deal!
    And if you review other similar cases in NY and across the USA for both distribution and possession, involving this same major volume of images and videos, with kids under 12 being brutalized, you'll find that that the best-case FEDERAL plea deals tend to fall in the 13-20+ year minimum sentence range > with 85% of sentence required to be served before parole eligibility
    I would be shocked IF the BEST plea deal offered right now was anything much less than 15 years minimum best-case > also according to several child porn lawyer blogs I've researched > with parole eligibility in 13 years
    Which is exactly why Austin Wolf and his lawyers haven't jumped at anything else > cuz the minute they reject the motion of continuance, his court appearance will take place, a trial date scheduled, and his prison sentence fate will be in the hands of an actual Judge who must follow the likely even more harsh minimum / maximum Federal sentencing guidelines!
