We've had multiple situations like that since I've joined the forum, in this case at least it was an alleged accident, but in many other cases it was nothing but greed and homophobia. I just hope nobody makes a connection between the ethnicity of the 2 escorts involved and the crime they committed, as we all know when a black man does something, he did it because of his race and all black men are held responsible for his actions. :(

I love the defense. The robbery and subsequent using of the guys credit cards was to give them cover because him accidently dying while sucking cock would make them look bad.

 

You can bet that if they had no history with the guy they would've pulled the gay panic defense out.

I started a thread about these two a while back: Only because I was here and remember when it happened and had several buds in that hood who knew the victim. I "believe" he initially met this pair at an arcade not on CL but I'd have to go back and re-read, bottom line thou he did have a semi-relationship with them as in it wasn't the first time he'd had them to his apt. Think what we glean from this is (unless they're tried n true as in long trusted individually as well as as a team) being alone with TWO guys (esp pick-ups) is HIGH on the risk scale and NEVER a good ideao_O

It's a tragic tale but a cautionary one - lots of guys are looking for "rough street trade" type guys but unfortunately these hustlers know it too. Almost all are criminals - hustlers and junkies with a long arrest records- that are looking for fast money and they know gay men are easy targets and most won't report any crimes out of embarrassment

these guys are murderers, but, shoot, that picture of Martinez-Herrera in the original Daily News link upthread is sad....he looks worn out and scared.....maybe it's just the picture, but I feel sorry for him.....I know he murdered a good guy, but, well, you know......

It's sad the victim lost his life and he suffered horribly in the end. Looking at the picture of the murderers, they are fugly, disreputable looking and described by someone as street trade. There is no way someone with any common sense should put themselves at the mercy of two such individuals, either one time or many. Either the victim was given no common sense at birth or he lost it somewhere along the way. This reminds me of someone I know that lives in another state. He recently qualified for a concealed carry permit. I asked him why. He said one reason is that there is a restaurant in a bad part of town he'd like to go to and he thinks he should be able to go anywhere he wants. People shouldn't be shocked when they go looking for trouble and find it or when they find they lose control in the face of it. Gesh, if one has absolutely no trace of common sense, go to a licensed someone and see if they can inject it. Also, don't leave keys in an unattended car with the engine running (yes, people in the winter do that). Don't count your fat wad of cash in front of strangers. Don't post your real name on a website and say exactly how you cheat on your taxes. Etc. Sure, bad things happen to good people but even letting someone else know you're doing something beyond extreme isn't going to bring you back from the afterlife. Take an extra 5 seconds, take a deep breath, THINK with the head attached to your shoulders (not between your legs), and then take a really cold shower before you call someone well known/reviewed. When I go its going to be from old age or a meteor falling on my head from the sky, not because I was being extremely reckless with the one life I've been given. Yes, looking at this situation from the outside may allow for 20/20 vision but I don't think that's the case here. The victim was really reckless. The outcome sad and avoidable.

 

And even though the two admitted to their crimes, there is support for them (follow the link). No wonder some are so harsh in their views of "our" lifestyle.

He was bound, hands and feet tied with a lamp cord, and his face covered with the duct tape that caused him to choke to death. While I APPLAUD efforts in the LGBT community to speak out when people are unjustly railroaded and seek support for them, does THAT scene sound to ANYONE like a SEX SCENE??? Not a soft rope or a leather strap, a LAMP CORD??? Like any john requesting that scene would say to his hired hustlers, - now, unplug that really nice lamp over there and tie me up with that o_O These scuzballs "may" have intended only to rob him at first (for a second time) but he died as a result of what they did to him so they're guilty as sin and this trans/sex worker community support effort makes me barf, it's no better than the Cath Church aiding and covering up for IT'S rotten apples.

In Australian law (NSW law to be specific), reckless indifference to the likely effect of an action is an alternate proof to intent. So if a defendant should have been aware that death could result a murder conviction would be appropriate. It can also be termed reckless negligence.

Short answer: No, intent did not need to be proved.

 

Longer answer: They were convicted of felony murder, which is but one of the twelve circumstances that can result in a 1st degree murder conviction in NY.

Actually an acquaintance of mine had the same thing happen recentlyeven after everyone warned him but he did survive. He likes those "street thug types" and met one who he was - well stupid enough - to invite to his home. He met him in all places that slime pit Craigslist. Apparently the thug wanted the money upfront this guy refused then the thug guy had a buddy in his car who came out and beat him and ransacked his home. Apparently an iPhone, iPads, tv, money and some jewelry were stolen. He was tied up - don't know what they used - and they kicked the shit out of him. Both thugs were caught, both had long rap sheets and both were on parole too. Apparently they've been robbing gay men for awhile. Very very very scary shit but as pointed out here - either you're a complete moron or were only thinking with your dick to put oneself in this inevitable danger.

I do know the tall guy ... he was a well known street hustler in the West Village. He LOVED to seduce trans women - hookers in most cases. He would move in with them. Once they trusted him a bit, he would beat them up and steal absolutely everything they owned. The trans were too scared or too embarrassed to go to the cops. That was his reputation on the street.

 

I am glad he is locked up for a LONG time. And it is too bad that somebody got murdered to make that happen.
