Sex on the beach might sound fun, but we do not recommend it after this: Jose Caballero, 40, and Elissa Alvarez, 20, were found guilty Monday of copulating on Florida's Bradenton Beach, and now they face up to 15 years behind bars. Video caught the couple's "lewd and lascivious behavior" last year, and witnesses testified the in-broad-daylight act was seen by a 3-year-old girl, the Bradenton Herald reports.

 

State attorneys plan to pursue prison time and a tougher sentence (possibly the maximum sentence) for Caballero, who has a prior record, and jail time for Alvarez. They also must register as sex offenders. The defense argued, unsuccessfully, that Alvarez was simply "dancing" atop Caballero to wake him up, since neither genitals nor penetration can be seen in the video.

Always bring a blanket. Sand gets into places where you don't want it and gives cover to prying eyes. Even better do it at night.

On the upside, apparently, the police took them alive.

 

More rare than it should be. Another horrible video came out today of a suspect surrendering and while starting to lie down on the ground, the cop kicks him in the face. Who is hiring these jackbooted thugs? And the victims and taxpayers keep paying.

15 years is ridiculous for what happened. Murderers often get less. The "justice" system is screwed up. I'm not defending what the couple did but why make two people useless in society, cost taxpayers hundreds of thousands in prison costs and who knows how much when they are out and can't sustain themselves. Some time in jail (maybe a year), some monetary fine and lots of hours of community service might have been a better outcome.

I totally agree. Unless there is a whole lot more to this than has been revealed, the justification for the parameters of this prosecution escapes me.

I particularly like the quote "and this went on for 25 minutes" I do not know if she is shocked or jealous. I do have to give the guy props for being able to maintain wood on the beach with families watching. But the possibility of years in jail is ludicrous.

Why not just give them probation with a sentence to clean the beach for two years. Fucking on the beach may be an offensive act, it may be a very stupid act, it may even be an illegal act but it certainly isn't a dangerous act. That is who should be in prison. I thought that is what the whole movement regarding redoing drug statutes was all about. And to make them register as sex offenders for a consensual act is patently absurd. Why not use the resources to go after rapists and child abusers?

A child was a witness. Oh the horror. Let's put them up against a wall and shoot them while the child watches and there would be less concern.

And registered sex offenders puts them in a category with child molesters and rapists and follows you around everywhere. Sex on the beach, Hell it is a drink for god sakes. They should be forced to wear a Scarlet I for the rest of their days. To insure they never do it again. they both should have to dump a cupful of sand in their butt crack ever day, just to reinforce the biggest horror of beach sex (I speak from experience here but it was at night and under a blanket with clothes still on)

The prosecution would have to convince me that a 3-year old child's perception could have been anything other than two people playing in the sand.
