Unless a customer pays the bar and the bar later pays the dancer for lap dances how could the state ever enforce such a tax?

 

At most NYC clubs customers pay the dancer directly for lap dances unless there done in a VIP room.

 

Soulds like a cluster _ _ _ k.

According to the LA Times article (link below), that's exactly how the Albany area strip club operated:

I do agree with Tazmanian5230's basic premise. Since it is not revenue for the strip clubs, NY State probably can't collect taxes on lap dances in establishments where customers pay the dancers directly. However, with this decision from NY State's highest court, it is possible, or even likely, in this revenue-hungry state that the NYS Department of Finance auditors may begin to enforce the ruling by starting to collect taxes on strip club admission charges.

Since New York does not collect sales tax on clothing purchases under $110, it would stand to reason that if the escort takes off clothing under the value of $110, no sales tax would encrue.
