Do not hesitate! Write that letter of invitation to secure him a B-1/B-2 visa today! You will be required to furnish proof (banking, brokerage account statements) that you can be responsible for him financially.  Upon arrival, insist that he hand over this papers to you for safe keeping as possession will ensure that he does not run away. Some day, I will relate the hoot n'holler story of Jimmy Hanrahan and his pretty Belarusian import, Konstantsin Sotnikov. And, then, of course, there was "Uncle Jack" Stallworth and "Terrible Timmy" who, indeed, lived up his billing. . .

Both parents having been killed in the fighting, he is an orphan child. Having done this once with great aggravation in the end of the thing, I cannot undertake to do it again as a matter of prudence; in the event the invited person runs off, if you will, you remain responsible for them.

1) Ignore the talk about B1/B2 visas.  B1/B2 is a tourist or business visa, and does not give the holder the right to live in the United States, but only to stay (typically) for 180 days.  Not all people being deported today arrived illegally -- many arrived with a B1/B2 and stayed too long; the overstay is improper and, if long enough, can result in deportation and barred re-entry.

2) Especially ignore the talk about an American sponsor for a B1/B2.  That does not exist, and even if someone had written such a letter, the US government has no way to pursue the American as the contract is not binding; the visa officer will most likely consider it a negative as it demonstrates that the applicant doesn't have resources of their own.  214(b) of the INA says that B1/B2 visa holders must demonstrate they have the means and intention to travel internationally and have sufficient ties that obligate them to return to their country of origin (i.e., some combination of job, family, property, etc. that no one would/could abandon).  Requiring the assistance of an American undermines this and worsens their chances of receiving a visa.

3) Consult an LGBT-focused immigration/refugee group like Rainbow Railroad.  RR works in Ukraine.  They are experts in law, can assess your situation with your full details and an understanding of the law, and give you advice that is useful.  In any event, get legal advice from legal experts, not wikisourced from bulletin boards with unknown experience or qualifications to advise.

4) @Kylostar, delete the RM profile.

Asterik knows it all. I have only my "practical" experience upon which to rely. I am well aware that the B1/B2 is a tourist or business visa with a limited stay; I will state, that as a matter of fact, Konstantsin Sotnikov , who was "invited by Jimmy Hanrahan, extended his "visitor's stay" to close to a decade and became a fixture, a celebrity of sort, of South Beach cafe society in the course of that time. The young man in question is deperately seeking an immediate open door out of Ukraine; I rather doubt he is looking ahead "long-term" and perusing US immigration statutes as his bedtime reading material; a B-1/B-2 visa that gets him on an outbound plane is his key to the realization of that ambition. As for myself, the immigration officer came calling when the person I had invited some years before was caught up in a traffic accident involving injury to a third party; the immigration officer was followed by the injured parties' attorney who produced my letter of invitation with its "guarantee", if you will, of my ability to take care of the boy financially. However, as by Asterik's PM request, I withdraw all of my posts pertinent to this matter. After all, what do I know? I defer to the expert.

I am assuming they have scaled back their work in the USA with the current situation going on, but I have donated to and helped sponsor two refugee's with the Rainbow Railroad.  For me, it was an incredibly rewarding undertaking...these guys were from a pretty awful situation and they ended up getting to come to the USA / get legally married / become legal residents of the united states.  These guys really did face potential death in the country there were leaving, which is something I still have trouble wrapping my head around.

The organization is really good and makes an awesome unusual birthday fundraiser.

Your posts conflate different parts of immigration law and mix in hearsay and gossip, which will mislead and confuse someone who is sincerely in Kylostar's position.  They are a disservice to him.

As a non-expert, better to defer to experts, like Rainbow Railroad, who are responsive, informed, and current.

(And I privately asked you to delete them because they are harmful, not "withdraw" them. We can go through letter and verse about the errors and false assumptions, but my intention here is to help kylostar, not win a pissing contest with some Jimmy Hanrahan's buddy.)

I stand by the advice to @Kylostar -- consult an immigration expert for legal advice, not this forum.

I referred him to an acquaintance, an immigration attorney, who informs me he is asking $800 to "bounce" from Ukraine.

I referred him to an immigration attorney who informs me that he is asking $800 to "bounce" from Ukraine. You may have over thought this matter; then again, if you truly want to be helpful beyond advice,  he accepts any number of cash transfer venues. Go for it.

I’m reaching out with an open heart, hoping for understanding. I’m currently in Ukraine, and as a man of conscription age, I’m not allowed to leave the country legally. However, due to the ongoing war, constant missile attacks, and the real risk of being drafted, I’m trying to find a way to escape to safety abroad. To do this, I need to raise money to obtain the documents that would make it possible for me to leave. I’m not asking for charity, if you’re interested, I’m also offering personal videos for sale, but only for those who are part of the LGBTQ community. I’m not trying to deceive anyone. I’m simply in a situation where I have no other choice but to ask for help. Life has put me in this position, and your support could truly change everything for me…
