Hey man,

I love this fascinating theme!

I know that the information that there is available in the net is sometimes mutually contradictory. I prefer to quote my personal lawer and adviser in how to read the law. Also, I quote what I was told when I received my license. They insist that we do NOT have permission to sell sex. That's why we are social escorts.

Related to being in a private place with a public view, as you know most of the times law works based in precedents and how past cases have been ruled.

Few months ago a man went to trial for having engaged in masturbation in a place where his neighbours could see him. Not only they could see him, they had time enough to unpack their camera and make a lenghty 12 minutes video of the candid masturbator.

The snoopy neighbours were in utter disbelief when the judge ruled the man innocent. He was in his private home. They went to all the work needed to witness his practices. He was deemed having the right to do whatever he wanted.

 

I wish I could have the link to the publication... I don't even remember where that hapenned. (It was Canada of course) You might be able to google it under the title "Public masturbation is okay". Something like that.

 

As for cellphone being a public place, lawers keep repeating that laws about prostitution in Canada are just created and enforced to protect the workers. There is no need at all to prevent people from communicating openly. There is no precedent at all of someone being prosecuted for calling, emailing or even sending a letter to a prostitute.

 

Contacting a street prostitute, though, is illegal, because it makes our streets unsafe, makes them a place where drugs theoretically are used more actively, and streets as we all know, are used mainly by underage runnaways trying to survive. That's why there is zero tolerance.

 

I find it really interesting how areas so traditionally mutually exclusive like prostitution and laws get together to enforce one another. And of course, how difficult it is to come up with the perfect wording for them to be flexible enough to be fair, and strict enough to be safe...

 

I think this is what real democracy is about. (but what the fuck do I know? :+ )

Loophole lets R.I. prostitutes work indoors

PROVIDENCE, R.I. -- Sex is for sale in the state capital, and police here say there's little they can do about it.

 

Although soliciting sexual favors on the street is illegal in Rhode Island, authorities say a loophole in state law allows prostitution behind closed doors - including in storefronts that advertise as massage parlors and spas just blocks from City Hall.

 

"We don't have a law criminalizing prostitution indoors," said Providence Police Lt. Thomas Verdi, who leads the department's anti-prostitution efforts.

 

Police and city officials have pushed for legislation to toughen anti-prostitution laws, although some say adding more laws to punish prostitutes is unnecessary.

 

State law prohibits loitering for the purpose of prostitution, as well as harboring or transporting prostitutes. But the sale of sex indoors is not specifically banned.

 

Providence Police Lt. Thomas Verdi, who leads the department's anti-prostitution efforts, said there are about 10 spas that serve as fronts for prostitution in the city, including at least two near City Hall.

 

A woman who answered the phone at Bally Day Spa said it was not a house of prostitution. Midori Spa could not be reached by phone for comment.

 

Verdi said police have raided nearly every suspect spa and massage parlor in Providence and charged women there with prostitution, but the charges were thrown out because they are not doing anything illegal.

 

"None have closed their doors, because they don't have to," he said. "They continue to operate, continue to ship in their girls."

 

Michael Healey, spokesman for the Attorney General's office, said there are laws on the books that can be used to prosecute prostitution that takes place indoors. But he said tougher laws are needed to help police.

 

"There's just no explicit language in that statute that says ... it is illegal for a john to pay a prostitute for sex in a room or in a spa or in a motel or something," Healey said.

 

Steven Brown, executive director of the state chapter of the American Civil Liberties Union, said he does not understand why Providence police believe prostitution is decriminalized.

 

"The current laws on the books have real teeth in them and are available for use right now," he said.

 

For example, he said police could establish a connection with a prostitute willing to cooperate with police, although Verdi said that is extremely difficult.

 

Police also need proof of a sex-for-money exchange, which is difficult, said Joseph Moran, police chief in Central Falls, who is also a state representative.

 

Earlier this year, lawmakers considered legislation that would have made prostitution a misdemeanor punishable by up to 6 months in prison and a $1,000 fine. But the bills died amid criticism that they targeted prostitutes rather than those who exploit them.

 

"I want to get at the source, not the poor woman who was being used in this way," said state Sen. Rhoda Perry, a Providence Democrat who sponsored the Senate legislation but later withdrew it.

 

Brown said he doubted police would be able to get at pimps by punishing prostitutes with new laws.

 

"I'm not sure that the prospect of a 6-month jail sentence is going to convince them to snitch," he said.

 

Garry Bliss, director of policy and legislative affairs for Providence Mayor David Cicilline, said revised legislation to target prostitution will be introduced when the General Assembly convenes next year.

It is always smart to follow the advice of your own lawyer as he is aware (or should be) of the local environment in terms of law enforcement in the morals area. Community standards do influence the cops and what people can do in places like Montreal does not necessarily hold in towns like London, Ontario, just as an example. Even in Montreal, enforcement of the soliciting provisions and other laws like the bawdy house law can vary over time, it seems, and it pays to be aware of what is going on around you.

In areas that prostitution is illegal, if you have sex with someone to which you've given money for their time, you cannot be sure that you will not be charged with solicitation.

 

Even if you don't talk about sex, don't exhange money, and so on, the cops will likely lie to get a conviction.

 

That said, I think the following tactics can reduce your risk:

 

- INDEPENDENT ESCORTS : Cops are less likely to bust an independent escort. They prefer to go for the headline makers. Why would they mess around trying to bring down one boy running around when they could bring down 25 boys plus their "pimp"?

 

- REVIEWS : If you're very concerned about sting operations, stick to guys that have been reviewed. Although cops *could* submit reviews for one of their own, it's unlikely they'll go through the effort. Also, hopefully Daddy will be sharp enough to smell the BS. :)

 

- CHATTING & FORUMS : If you see someone that consistantly uses the SAME screen name on different chat rooms and forums (like here), they're not likely a cop.

 

- CONTACT METHODS : The more ways you can contact (email, cell, IM, forms) an escort, the less likely he's a cop. Particularly if this contact information is publicly posted and doesn't change.

 

- START WITH BODYWORK : Hire the escort for a bodywork only appointment first. Most top escorts will have the same rate for bodywork appointments as "escort" appointments, but it's a way to weed out cops if you're really concerned.

 

With all these in mind, remember that for the most part, cops are looking for street workers, not escorts...the public is annoyed by street workers, but have little to say about us emailing and calling each other to meet up behind closed doors.

Hey ESN, Don't know where you live but if there is a HooVille meeting in your area, by all means attend. Our group meets 3 or 4 times during season and is just a group of guys getting together for dinner. Usually hiring isn't even talked about that much. This might make you more comfortable with the whole process. Also, as everyone else has said, if you stick with well reviewed escorts, who have been around for awhile, you aren't going to get setup. Hope you can accomplish your goals!!!
