Apparently he only blew a 0.02,which is a quarter of the legal limit. I thought you had to be at least half the legal limit to get charged, but perhaps he had other medications he was on.

OR....this was at Sandy Hook, aka the nude beach area of NJ which is pretty cruisy...hmmm....
