Given that it's pretty clear the flight attendant was aware he was being recorded, unless he had some sort of promise from AW that the video wouldn't be shared, a court would probably presume that he realized it could be shared and either implicitly consented or proceeded at his own risk. He didn't need to give written permission. It is unlikely he could pursue a claim.
