This is a good reminder that prostitution, or sex work, as I prefer to call it, is not the same as escorting. While people often use the terms interchangeably or euphemistically, the distinction is legally important. The exchange of money (or anything of value) for sexual contact is a crime in most jurisdictions. Escorts, in contrast, provide someone companionship for a fee, which is legal. Such companionship may be more common than people think. Sometimes people just want to spend time hanging out with a cute guy, or go on a “date” as part of their coming out process, or go to a dinner or event with a smart, sexy companion. Such engagements might just involve conversation and there are some providers who mix in coaching or counseling from a supportive, gay-friendly perspective. There could also be a physical component, like massage (w/out a HE) or cuddling that would not cross the line into illicit sexual contact. Of course, it seems likely that many people who provide escort services also go beyond mere companionship to additionally provide sexual services for their clients. In doing so, they are probably crossing the line from legal to illegal activity. But this also raises questions of proof. In general, I suspect that the longer the time spent together and the more hanging out/non-sexual companionship is involved, the harder it would be for the State to prove that prostitution laws are being violated. Ponder this: if an older, wealthier man starts dating a young pretty woman and buys her lots of jewelry and then starts providing her an allowance, are they engaged in prostitution, the exchange of money for sex? Arguably, yes, but that would be a much harder case to prove than the case of a 10-minute blow job in a dark alley for $50. I don’t know what’s going on with this particular advertiser, but perhaps he’s trying to attract a clientele that is more like the former than the latter.

While I understand your perspective and desire for a commonly understood and agreed upon system of terminology, I think the person paying for the ad can call himself whatever he damn well pleases. Aside from this point, I have to say that I profoundly disagree with your assertion. My own view, as I stated above and in many other posts over the past two years (and have fully supported with citations and examples) is that escorts provide professional companionship. Period. To the extent someone may be trading sex for money, he is engaged in the crime of prostitution. While many people treat the term "escort" as a euphemism for "prostitute," it is only the reality that they are not the same that allows escort advertising to exist in this country. I would remind you that the RB prosecutors were not free to arrest Mr. Hurrant merely based on the assertion that "escort = fucking for money." They had to conduct an extensive undercover investigation to be in a position to prove that at least some advertisers on his site were actually engaged in prostitution despite disclaimers to the contrary and that he was aware of and profiting from this fact.

 

IMHO, the claim that the term "escort" is just another word for prostitute is not only inaccurate, it also has dangerous implications.

I certainly can appreciate what you are saying. However, as someone who used to make cases against people in the legal system, just not using the word would not free you from liability. A case is crafted from all the circumstances and checking that you are "into" anal, oral, toys, etc. and that you offer "activities in the bedroom" make it hard to explain why you are not in fact a sex companion, no matter what words you may use. Also clients are going to ask you for that info somewhere down the road if that is what they are interested in and you are going to have to give the authorities that info. So, yes, for sure it is harder but in no way impossible.
