As anyone who really knew Hooboy, knew he ONLY wanted Foxy to run his website, I do hope that the powers that be will look back and remember what Hooboy wanted and put Hoo's wishes ahead of any other agenda.

Wasn't a will prepared? It would seem to me that anyone with the "ability" to continue the site and access the files, etc., is the one with the blessing from the owner???

Good question, joel. No matter what one says he wants, it is not binding after death unless the proper legal documents are prepared beforehand. Guys, get your will written, get a durable power of attorney for health care now, even though you will not need it for a long time! Maybe.

Lucky, I trust your opinion but have a question about wills that I hope you can answer.

 

I've been told that wills can be contested and are not "iron clad". On the other hand, I don't think a trust cannot be contested and might be a better choice for some people than a will.

 

Can you enlighten us on the will vs trust issue?

My guess is that woodlawn could answer this better than me, but a will should be "ironclad" if properly prepared. Anybody can contest anything, but it doesn't mean they will win. But one thing I can guarantee is that a verbally expressed wish will only be carried out with the goodwill of the heirs. One reason I never went into this kind of law is because trusts confuse me. (woodlawn, I do know the rule against perpetuities though!)

MANY of Hooboy's closest, dearest, and long term friends have been having extensive on-going discussions about this. You are very welcome to be a part of those discussions.

 

However, they WILL NOT be taking place on this forum and they WILL NOT be final until the family matters have been finished.

 

Thank you for the tremendous support, and the concern that you have shown over last few weeks. You are "One of the powers that be" and your opinions are an important consideration as we move forward.
