The "sad little posting" is all down to the prosecutors at the US Attorney's office for the Eastern District of New York who greenlit the arrest and prosecution. As far as I'm concerned, the DHS agents were just doing their jobs. They're not being paid to exercise discretion. That's the lawyers' job.

 

There's this thing called prosecutorial discretion. The AUSA prosecuting the case and the US Attorney who approved it are the ones responsible for this mess.

There’s plenty of blame to go around for this misguided prosecution. I wouldn’t limit it to the prosecutors, although they presumably made the final call to proceed. The agency too has to decide how to prioritize spending its limited time and money. Of course, once they have a budget dedicated to electronic surveillance and monitoring the Internet for potential illegal activity, they have to come up with something to justify that budget and try to expand upon it. Here’s an interesting article that touches on the agency politics involved.
