Thanks for the info -- in fact, however, that standard is virtually identical to the standard in several other states with which I am familiar. So how does sending letters telling someone you are going to disclose that he is an escort (which he is) meet that standard?

I don't know that it does or does not. I'm not an attorney. I think he should hire an attorney to help him sort this out and take whatever legal action is appropriate. That's why I sent him the name of a good, competent, gay attorney in Boston.

 

Evidently, he's been being harrassed by someone for a period of time now. It's bothering him a great deal and may cross the line into illegal behavior that he can do something about. But his first step should be to consult with a good attorney.

He probably should. My question was prompted by the fact that I see a number of people posting here advising him that he can go to a judge and get a restraining order even though the conduct he describes in his post doesn't meet the criteria for such an order, insofar as I'm familiar with them.

 

Under the Massachusetts criminal stalking statute, it is necessary to prove that the perpetrator made a threat with the intent to place the victim in imminent fear of death or bodily injury in order to sustain a charge.

 

The Massachusetts criminal harrassment statute has a much lower threshhold, requiring only that the perpetrator's actions be such as would cause a reasonable person to suffer substantial emotional distress.

Hi BostonChris,

 

I'm sorry that I didn't see your post earlier (but I had clients :9 ).

 

Your story made me think of the story of another escort I once read on another board. He too got harassed, and maybe that story can be useful for you:

 

He got phone calls from someone, repeatedly in the course of the day and night, every few hours or so, number identification was off and the caller would call the escort unpleasant names, and there wasn't a lot the escort could do (exept not answer the phone, but that's not the best option).

After a while the escort reported to the police that someone was harassing him. Maybe the escort didn't report that he was an escort (maybe that he was a masseur). Although number identification was off, those who have authority in the right systems could get the number, and the police has the authority.

 

After a day or so, when the escort got the number from the police (after the guy had been calling again), and after the guy called once more, the escort called the guy straight back and asked the guy why he was calling him. It scared the hell out of the guy. It turned out to be a 17-year-old boy who was struggling with his own homosexuality. The boy was still living with his parents, and was terrified that the escort would drop charges, because that would turn his life inside out. "He was shitting bricks" the story actually told, and the harassment stopped instantly.

 

Back to your case, if you know who the harasser is, I'd first try to get evidence (or convincing material) of his identity. There's always a chance that once your harasser realises that you know his identity, and once he realises that you can turn his life inside out (even if you won't) he has only one choice: to stop.

It's BRING charges. You DROP charges when you decide not to prosecute / persecute.

I am a lawyer and you don't need one here. Take your evidence to the precinct and file harassment charges. The police will help you. Provide the name and detectives will call him or pay him a visit. Mentioning key words such as "threatened bodily harm," etc. are a good start.

Ah, me. I assume you are in the "escort" business, and, if that is a matter of fact, be prudent in discussing your activies with law enforecement officers. You might "get justice", and, incidental to the matter, find yourself the subject of a criminal investigation. It does happen. If you have income tax owing from professoinal servuces rendered as an independent contractor, that is, as an escort, pay up now and be done with it. I encourage those of my acquaintance who pursue escorting as a career to vet their clients as I vet my "hires"; on occasion, a person who presents nicely as a prospective client can prove a personal and professional disaster.
