Charges dropped against Florida man arrested for 'I Eat Ass' sticker on his truck

Charges have been dropped against a Florida man who claimed his rights were violated after he was arrested last week for sporting an "I Eat Ass" sticker on his truck.


In a May 9 letter to the Columbia County Sheriff's Office, Assistant State Attorney John Foster Durrett stated that all charges against 23-year-old Dillon Shane Webb have been dropped, and that his "I Eat Ass" sticker is in fact protected by the First Amendment.


"Having evaluated the evidence through the prism of Supreme Court precedent it is determined the Defendant has a valid defense to be raised under the First Amendment of our United States Constitution. Given such, a jury would not convict under these facts," said Durrett in the letter.


Last Sunday, May 5, Webb was pulled over on Highway 90 after an officer with the Columbia County Sheriff's Office spotted his "I Eat Ass" sticker on the back of his Chevrolet truck. According to the Lake City Reporter, the deputy claimed the sticker violated Florida Statute 847.011, which deals with possession and distribution of obscene material. The officer then instructed Webb to remove one of the letters from the "I Eat Ass" sticker, to which he refused, and was promptly arrested for resisting without violence and possession of obscene materials.


Webb was later released on a $2,500 bond.


An attorney for Webb told Anne Shindler of First Coast News that a lawsuit against the Columbia County Sheriff's Office is now likely.


"Now we transition from defense to offense," said the attorney. "The First Amendment was our defense. What is Sheriff Hunter's defense? We will find out!"

Rather than dealing with the unpredictable maintenance burden on the driver's own car he or she uses this deal where Lyft provides a car through a rental company and charges a fee for the vehicle and insurance off the top of the driver's ride income. The fee drops substantially as you average more rides per day, so there's a big incentive to work long shifts.

It's been a long time since I've met a casual Lyft driver. It's kind of rare to see one driving his or her own car. This business model was sold as part of the "gig economy" but it has transitioned into a fairly direct replacement for taxi companies -- without the regulation and employer responsibilities.

Check your Google voice settings. When I receive texts using Google voice they also appear in my IMessages. It's very possible that he received the texts through IMessages and not Google voice.

Taxi medallions in NYC cost $1 million+ before Uber & Lyft. They are valued at $150-200 thousand now. Cabbies have lost their homes because they couldn't pay their mortgages. Some had mortgaged their homes to finance the purchase of the medallions in the first place. Now it looks like we'll get 'congestion pricing' soon in mid-town Manhattan, which will add a $2.25/ride surcharge to each fare, which could further reduce ridership.
 
I don't know what the answer is because Uber & Lyft have been very beneficial for so many people, but there are many cab drivers suffering in NYC and the 9 suicides in the past year unfortunately probably won't be the final total.
