The regulation is pretty clear that the ID requirements apply only to a graphic depiction of actual sexual activity. I doubt that most of the pictures on this site would be covered by this requirement. Even a still shot of a single model with a hard-on is doubtful, in my view, but of course we won't know for sure until there is a test case in the courts.

The Free Speech Coalition lawsuit that was filed yesterday may produce some clarification on these points or, one hopes, may lead to invalidation of the regulations as far exceeding the mandate of the statute.

I'm sure it will be comforting to the guy(s) facing 10 years in jail that IN YOUR VIEW it's doubtful. The actual language in the law isn't quite so clear.

 

(Am I the only one that remembers the feds trying to define obscenity saying "I can't define it but I know it when I see it." We're back to that.)

 

RadVideo.com has now pulled photos from all videos they didn't create until they receive the required records from the original producers. (See http://www.radvideo.com/censored/index.php) ATKOL.com appears to have pulled their "video of the day" box cover.

 

I'd imagine those business owners are not as comfortable as you are with your own interpretation.

We can only hope.
