Suing because of waking up wearing pink panties?

 

A groggy Delaware man roused from a colonoscopy exam only to find himself sporting a pair of pink women’s underwear.

 

Andrew Walls, 32, of Dover, has no idea how he ended up with the unmentionables, but suspects his colleagues, employees at the Delaware Surgery Center, had something to do with the 2012 prank while he was under anesthesia...

Well, there certainly should be disciplinary action against any health professional involved in the prank. He should have filed a complaint with the medical board and nursing board against the doctor(s) and nurse(s) involved, due to unprofessional conduct. In terms of suing for damages, though, that's quite off-base. I don't see that there should be any monetary award. It seems like a frivolous lawsuit. The health professionals responsible should have their licenses put on probation, and be required to take ethics courses.

He admits that he has "no idea" how he awoke in pink panties so this is likely to wind up in an accuse and deny situation. Those accused can simply deny responsibility and could certainly raise the possiblity that the panties were worn specifically for the purpose of instigating a law suit. Without an admission or a witness, I am afraid that the medical practice will not be caught with its pants down.

An acquaintance of mine is a male nurse in the Colo-rectal unit of a local hospital. He's openly gay and has a wicked sense of humor. He told me that several years ago when he had his colonoscopy, his colleagues played a practical joke on him. While he was under the anesthesia for the procedure, they used a black marker to write "Thanks Guys" on his buttocks.

 

He found it hysterical and enjoyed the prank immensely. He said he went to the gym the next day and had no issue showering with "Thanks Guys" prominently displayed on his butt. It took several days to get it washed completely off but he didn't care. The reaction at the gym was priceless.

 

Now he could have freaked out, filed a complaint and sued for gender orientation discrimination. Clearly some would in this circumstance. Instead, he laughed it off and expanded the prank to guys at his gym. He vowed to get his colleagues back for such a stunt and I'm sure he did so in a very elaborate manner.

+1 It's a shame that some people take all the fun out of life, but I guess it's inevitable in our emerging "it's all about me" society.
