Presently in Europa, and all the folks here are talking about Dominique's situation. His case has i intrigue: sex, money, international politics. Could this be the OJ trial of this decade, played out in a Harlem courtroom?

I don't get it either: sexually assaulting the maid at the Sofitel then unexpectedly leaving the hotel for the airport, just to be caught a few minutes later on a AF flight still on the ground ... what was he thinking, the head of IMF ... ?

 

DSK was considered (till yesterday) as the major pretender of Nicolas Sarkozy for 2012 Presidential Elections in France. With the current events in NYC not so sure so. He was recently in the news here for flashing in a $35 000 designer suit and a Porshe ... not so good for his image.

 

Everyone here says that there must be more to the story and that presumption of innocence should be respected at this time. Some supporters from the left even saying that this is a coup monté.

There are some other reports of "inappropriate" behavior emerging. Evidently his little head takes over his big head, at least every so often. You'd think he'd have better control of himself at his age, but evidently not. . .

Tri--Yes, and it makes me wonder why the woman in France is suddenly bringing it up now. On the news last night it was reported that some folks in France think that he was set up by the current president of France in order to end DSK's bid for the presidency. This could get very interesting. On the other hand, if he's did it...I hope he spends a long time in jail.

The rape shield law will make it tough for his lawyers to imply/say she's been promiscuous in the past, which would be their best bet given S-K's own history. Also, given where NYC sits on the political scale, any reasonable jury (unless it's all wealthy people) will sympathize with her. At best, I could see the men and the women will split, causing a hung jury.

For those of us not familiar with the US Justice System and not having a perfect command of English,

 

does that mean that the vote of at least one amongst the jury would be decisive?

I'm pretty sure the decision in a criminal case must be unanimous. In civil cases, I think a simple majority decides, although I'll defer to the lawyers on board to point out any exceptions.

 

If I recall, O. J. Simpson was acquited in a criminal trial and convicted in a civil trial. Could happen to Strauss-Kahn too, although I wonder if he could be kept in the U. S. to face a civil trial if he prevails in a criminal trial. Another one for the lawyers.

From what I understand, juries in a criminal case generally must agree unanimously on a verdict regarding a charge. If there is more than one charge, a jury can agree unanimously as to one charge and not as to the others. The defendant can be sentenced as to the charge that the jury agrees on. If the jury is not unanimous as to at least one charge, it is a hung jury and the prosecution can choose to try the case again. I think that certain states are changing their laws so that a defendant can be found guilty even if less than a full jury finds the defendant guilty on a charge.

The sexual assault case against Dominique Strauss-Kahn is on the verge of collapse as investigators have uncovered major holes in the credibility of the housekeeper who charged that she was attacked by the French politician in his Manhattan hotel suite in May, according to two well-placed law enforcement officials.

 

Although forensic tests found unambiguous evidence of a sexual encounter between Mr. Strauss-Kahn and the woman, prosecutors do not believe much of what the accuser has told them about the circumstances or about herself.

 

Since her initial allegation on May 14, the accuser has repeatedly lied, one of the law enforcement officials said.

Good lawyering for the defense, no doubt. A really good defense lawyer can go to work on the prosecutors and, if lucky, convince them that the case is not worth doing because they're not going to be able to get a unanimous jury.

Glutes probably has this one right. He's got the kind of money that plays havoc with the justice system.

 

(Reuters) - Lawyers for the woman who accused former IMF chief Dominique Strauss-Kahn of sexual assault have explored a deal in which they would scuttle the criminal case in exchange for a monetary settlement in the civil lawsuit, the Wall Street Journal reported on Friday.

 

The woman's lawyer, Kenneth Thompson, strongly denied the report, which the Journal sourced to unidentified people briefed on the matter.

 

The report comes ahead of Tuesday's scheduled court hearing in which Strauss-Kahn, once seen as a leading contender to be the next president of France, was due to appear before a judge for the first time since he was freed from house arrest on July 1.
