Published by Reuters By Andrew Chung and John Kruzel WASHINGTON (Reuters) – Judges, scholars, lawyers, government officials and current U.S. Supreme Court members paid tribute to the late Justice Ruth Bader Ginsburg on Friday, honoring a liberal stalwart and women’s rights pioneer whose 2020 death opened the door to a transformative rightward shift on the top U.S. judicial body. A rare meeting of the Supreme Court Bar, comprised of attorneys admitted to practice law before the court, featured speeches from people who worked closely with Ginsburg including U.S. Solicitor General Elizabeth Prelogar, who argues cases for President Joe Biden’s administration. “Her life was a quintessentially American story,” Prelogar said. “She was born to a family of immigrants, and grew up with modest means. She faced profound adversity and discrimination. Yet, through her intellect, hard work and force of will, she not only reached the top of her profession, she reshaped it. She broke barriers for those who came after her and she inspired multiple generations.” A similar meeting was held following the 2016 death of conservative Justice Antonin Scalia, a influential figure on the court whose memory looms large among conservatives just as Ginsburg’s does among liberals. The two jurists were close friends who shared an affection for opera. Ginsburg’s death at age 87 after a bout with cancer was an inflection point for the court. It enabled then-President Donald Trump to make a third appointment to the court – Amy Coney Barrett – who was rapidly confirmed by a Senate then controlled by his fellow Republicans. That gave the court a 6-3 conservative majority, further diminishing the power of its liberal bloc and paving the way for rulings like last year’s decision ending the recognition of a constitutional right to abortion. Trump also appointed conservative Justices Neil Gorsuch in 2017 and Brett Kavanaugh in 2018. The conservative majority has shown no hesitation in taking up contentious issues, also including a ruling last year widening gun rights. Based on arguments held since their current term began in October, the conservative justices appear poised in the coming months to end affirmative action policies used by colleges and universities to increase campus racial diversity, further undermine a federal law barring racial discrimination in voting and enable businesses to refuse certain services to LGBT people based on constitutional free-speech rights. Barrett was confirmed by Senate Republicans a week before the 2020 presidential election. Democrats accused them of hypocrisy after Republicans refused to act on Democratic President Barack Obama’s nomination of Merrick Garland to succeed Scalia during a presidential election year in 2016. Garland, a former federal appeals court judge who now serves as U.S. attorney general, was due to speak at a special sitting of the court following the bar meeting. Chief Justice John Roberts is also set to speak. Ginsburg rose from a working class upbringing in New York City’s borough of Brooklyn and prevailed over systemic sexism in the legal ranks to become one of America’s best-known jurists. Appointed to the Supreme Court by Democratic President Bill Clinton in 1993, she provided key votes in landmark rulings securing equal rights for women, expanding gay rights and safeguarding abortion rights. Ginsburg was the second woman ever named to the court, after Justice Sandra Day O’Connor. David was fired in September 2021 after New York state Attorney General Letitia James issued a report saying he had advised former Governor Andrew Cuomo about dealing with sexual harassment allegations, the organization’s board said at the time. David was identified in the report as having been involved in efforts to undermine Cuomo’s first accuser, Lindsey Boylan. David, who said in his lawsuit that he was the group’s first Black president, had held the post for two years. The Washington-based nonprofit group advocates for equal rights for lesbian, gay, bisexual, transgender and queer people (LGBTQ). The lawsuit alleged racial discrimination in David’s firing. The advocacy group denied that and said David was fired for violating the organization’s conflict of interest policy by assisting Cuomo’s team. The terms of the settlement were confidential, the two sides said in a joint statement on Wednesday, adding they chose to “amicably resolve” the lawsuit. Human Rights Campaign named a new president, Kelley Robinson, in September. Robinson is the first Black woman to hold the post. Cuomo, 63, stepped down as governor in 2021 after a state investigation concluded he sexually harassed women who worked for him. Cuomo denied wrongdoing. According to David’s LinkedIn profile, he was president of Human Right Campaign for over two years. Now a US federal judge, he is set to decide the future of abortion pills across the country. The 45-year-old Kacsmaryk has been in the spotlight ever since a coalition of anti-abortion activists sued the US Food and Drug Administration (FDA), seeking to overturn the federal agency’s approval of mifepristone over 20 years ago. By filing the suit in Amarillo, Texas, plaintiffs were certain to have Kacsmaryk oversee the case, as he is the only sitting federal judge in the city. That was not a coincidence, said ACLU project director Jennifer Dalven. The group behind the suit “was able to hand-select their judge,” picking one who “has issued a series of radical decisions” on hot-button social issues, Dalven said. “In any rational universe, this case would be laughed out of court on multiple grounds.” Conservative opponents to abortion rights have closed ranks around Kacsmaryk, who was appointed by former president Donald Trump and confirmed in 2019 by the then-Republican-controlled Senate. The judge is “the latest target of judicial intimidation” whose “real offense is his background litigating religious liberty cases,” said Carrie Severino, who leads the conservative legal group Judicial Crisis Network. Before assuming his life-long post as a federal judge, Kacsmaryk was a lawyer for the First Liberty Institute, a Texas-based group that focused on cases surrounding religious freedom. Those included representing bakers who refused to make a wedding cake for same-sex couples because it violated their Christian beliefs, and supporting a public high school coach who was fired after praying on the field with students. While at First Liberty Institute, Kacsmaryk openly opposed the Supreme Court’s landmark decision to legalize same-sex marriage as well as transgender people’s choice to use bathrooms of their gender identity. In a 2015 article, he decried the “sexual revolution” which he said was “spearheaded by secular libertines.” “Even the unborn child must yield to the erotic desires of liberated adults,” Kacsmaryk said. When the Senate was considering his nomination — confirmation of the president’s picks requires a simple majority — Democrats were strongly opposed, voting en bloc against him. Democratic leader Chuck Schumer at the time described Kacsmaryk as having “demonstrated a hostility to the LGBTQ bordering on paranoia.” Kacsmaryk nonetheless vowed that once in office, he would judge impartially without letting his beliefs influence his decisions. While he has mostly dealt with low-level cases since taking office in Amarillo, Kacsmaryk has already ruled once against the Biden administration when it comes to reproduction-related issues. Late last year, he ruled that a federal program which funds contraception for minors without their parents’ consent was illegal — although he did not order an immediate halt to the program. Yui Mok/PA Wire/dpa A decade and a half after she started making records — first as her Disney Channel alter ego, Hannah Montana, then as herself (or maybe “herself”) — Miley Cyrus on her eighth studio album sounds like a woman looking back at everywhere she’s been, both musically and emotionally, and assessing where all her travels have put her now, newly divorced and having just entered her 30s. The LP is called “Endless Summer Vacation,” which gets at the coolly euphoric country-disco vibe of a song like “Flowers,” the smash lead single that spent six weeks atop Billboard’s Hot 100 on its way to racking up more than a billion streams. But the true subject of these dozen tunes (plus a bonus-track demo of “Flowers”) is the hard work of introspection and the even harder work of self-reliance. “I love when you hold me / But loving you is never enough,” she sings in “Wildcard,” the sting of acceptance still fresh in her voice, “Don’t wait for me / ‘Cause forever may never come.” How to account for the enormous success of “Flowers”? Though she’s never lacked for showbiz visibility — see her recent New Year’s Eve TV special where she sang with Dolly Parton and David Byrne — Cyrus was a long way from her previous No. 1, 2013’s “Wrecking Ball,” when she recorded the winning empowerment jam with Kid Harpoon and Tyler Johnson, the same duo that produced Harry Styles’ Grammy-winning “Harry’s House.” And perhaps their golden touch had something to do with it; perhaps it’s the lyrical and melodic DNA the song shares with Bruno Mars’ chart-topping “When I Was Your Man,” a supposed favorite of Cyrus’ ex-husband actor Liam Hemsworth. But “Flowers,” which fans have heard as an explicit response to “When I Was Your Man,” also captures this veteran shapeshifter in just the right spot: peeved but amused, shady yet sincere. Thematically, “Endless Summer Vacation” revolves around Cyrus’ split from Hemsworth; she fondly recalls some of their good times, identifies red flags that arose eventually, ponders the pleasures and the complications of singledom and finally rediscovers a longing for romance. (In addition to Johnson and Kid Harpoon and other established pop pros such as Greg Kurstin, Tobias Jesso Jr. and Mike Will Made It, the singer’s studio collaborators here include her current boyfriend, musician Maxx Morando.) Stylistically, the songs pull from all over the place. Like the actor she is, Cyrus in the past used each of her albums to explore a single genre: hip-hop on “Bangerz,” psychedelia on “Her Dead Petz,” country music on “Younger Now” — remember that before she was a Disney kid she was the daughter of Billy Ray Cyrus — and hard rock on “Plastic Hearts.” Yet “Endless Summer Vacation” jams together bits of all that stuff as she moves through heartbreak to savor the clarity that follows. What holds the music together is Cyrus’ singing, which stood out easily from the likes of Selena Gomez and the Jonas Brothers in the mid-2000s and which still feels distinct now that she’s competing with SZA and Taylor Swift. In “Jaded” and “Muddy Feet,” she emphasizes the grainy texture in her voice over stomping rock grooves; “Rose Colored Lenses” has her rounding the edges of each phrase with a woozy sensuality. Brandi Carlile shows up to belt alongside Cyrus in the blippy-folky “Thousand Miles,” but she hangs back in the mix, limiting herself to ghostly high harmonies against Cyrus’ low growl. “River” and “Violet Chemistry” are the album’s most rhythmic cuts, with Cyrus doling out quick staccato lines amid ravey synths played in part in the latter by James Blake. And “You” is the album’s vocal centrepiece: a saloon-ready retro-soul ballad à la Rihanna’s “Love on the Brain” in which Cyrus channels the yearning of someone gingerly entering a new relationship and that same someone’s reluctance to get hurt again. Indeed, her singing is vivid enough on “Endless Summer Vacation” to make up for some mushy songwriting here and there: “Fingers start to dance along the figures and the shapes,” goes one line in “Violet Chemistry,” “mixing all the colours like we’re making a Monet.” (Yikes.) But to get too hung up on a cringey lyric is to miss the point of Miley Cyrus at this phase of her weird, winding, one-of-one career.
