Published by Reuters By Matt Spetalnick and Laura Sanicola WASHINGTON (Reuters) – A New York Times report of a former anti-abortion leader’s claim that he was told in advance about the outcome of a major 2014 U.S. Supreme Court case involving contraceptives triggered calls on Saturday for an investigation of a court still reeling from the leak of landmark abortion rights ruling. Rev. Rob Schenck was quoted by The Times as saying he was informed weeks before the public announcement of the 2014 ruling shortly after two conservative allies had dinner at the home of Supreme Court Justice Samuel Alito and his wife. Alito wrote that majority opinion as well as a recent one overturning the Roe v. Wade decision that had legalized abortion nationwide, both of which were victories for the religious right. Schenck, who used to lead an evangelical nonprofit in Washington, said in a letter to Chief Justice John Roberts and in interviews with The Times that he was informed ahead of time about the ruling of Burwell v. Hobby Lobby, a case involving contraception and religious rights, the newspaper said. Schenck used his knowledge of the ruling to prepare a public relations campaign and he also tipped off the president of the Christian evangelical-run craft store chain Hobby Lobby that he would win the case, according to The Times. Alito said in a statement that any allegation that he or his wife leaked the 2014 decision was “completely false.” Neither Schenck nor Chief Justice Roberts immediately responded to requests for comment. “Today’s well-sourced NY Times article strongly suggests Justice Alito leaked the 2014 opinion in Hobby Lobby, and describes a conspiracy by the far-right donor class to influence the Supreme Court Justices,” U.S. Representative Mondaire Jones, a Democrat from New York, wrote on Twitter. “The House Judiciary Committee must investigate this while we still can.” Brian Fallon, executive director of the progressive judicial group Demand Justice, called on the Senate Judiciary Committee to investigate, saying The Times’ report was “the latest proof that the Republican justices on the Court are little more than politicians in robes.” “The first step to recovery is to admit you have a problem. At SCOTUS, the problems run deep,” Democratic U.S. Senator Sheldon Whitehouse of Rhode Island wrote on Twitter. COURT UNDER SCRUTINY A draft of the majority opinion to overturn Roe, reversing five decades of abortion rights, was leaked in May, spurring scrutiny of the court’s procedures at a time when critics were accusing its conservative majority of politicization. Polls show that the court’s public approval has reached record lows. Alito had called the Roe leak, which was confirmed when the ruling was announced in June, a “grave betrayal.” Schenck was quoted by The Times as saying he had worked for years to gain access to the court and that in early June 2014 two of his star donors, Ohio couple Donald and Gayle Wright, ate a meal with Justice Alito and his wife, Martha-Ann. Schenck said one of the Wrights then told him that Alito had authored the Hobby Lobby opinion and that it would be in its favor, The Times said. The decision announced three weeks later held that requiring family-owned businesses to pay for insurance covering contraception violated their religious freedoms. In his statement, Alito said: “The allegation that the Wrights were told the outcome of the decision in the Hobby Lobby case, or the authorship of the opinion of the Court, by me or my wife is completely false.” “My wife and I became acquainted with the Wrights some years ago because of their strong support for the Supreme Court Historical Society, and since then, we have had a casual and purely social relationship,” Alito’s statement said. “I never detected any effort on the part of the Wrights to obtain confidential information or to influence anything that I did in either an official or private capacity, and I would have strongly objected if they had done so.” Gayle Wright, in a phone interview, denied obtaining or passing along any such information, The Times reported. Musk on Friday said he had reinstated certain banned accounts on his site, but added that no decision had been made on welcoming back former US president Donald Trump. Twitter watchers have been tracking closely to see whether Musk will reinstate Trump, banned for inciting last year’s attack on the Capitol by a mob seeking to overturn the results of the 2020 election. The reinstatement of accounts ousted for violating Twitter’s content moderation rules has been seen as a bellwether of where Musk, a self-described “free speech absolutist,” wants to take the site. In the same blast of tweets, Musk unveiled a new method for handling future hateful or “negative” content that seemed to seek a balancing act between unadulterated free speech and some form of policing on the site. Finding a solution to content moderation became especially urgent after Musk’s fist major rejig to the site — expanding a paid subscription service — sparked an embarrassing spate of fake accounts that sent advertisers running. “New Twitter policy is freedom of speech, but not freedom of reach,” Musk tweeted on Friday. “Negative/hate tweets will be max deboosted & demonetized, so no ads or other revenue to Twitter,” he wrote. ‘Core principle’ In essence, Musk seemed to be pointing to a policy similar to strategies at YouTube, the Google-owned video platform, where some provocative content is given less priority in the site’s algorithm, but is not entirely taken down. “You won’t find the tweet unless you specifically seek it out, which is no different from the rest of the Internet,” Musk said. Ella Girwin, his newly installed chief of trust and safety, called Musk’s approach “a core principle for Twitter… helping us ensure we maintain a healthy platform.” To make his point, Musk then announced the reinstatement of three twitter accounts that had been banished for violating Twitter’s content moderation policies. Canadian psychologist Jordan Peterson was suspended from Twitter in June, before Musk’s ownership, following a post about transgender actor Elliot Page that broke the site’s rules on hateful conduct. Peterson had often made comments against the rights of transgender people and was asked by Twitter to remove the post on Page. The Babylon Bee, a conservative parody site, was banned in March for similar tweets against Rachel Levine, a trans woman serving as US assistant secretary of health. The third account, belonging to comedian Kathy Griffin, was banned earlier this month when Musk cracked down on accounts that impersonated others. Griffin, who has two million Twitter followers, switched her username to Elon Musk, taking advantage of the website’s relaxed oversight under the billionaire. ‘Catastrophic’ In an opinion piece in the New York Times, Twitter’s former content chief Yoel Roth said it was a “near certainty” that Trump would be returned to the site. Expanding at length on why he had left Twitter last week after seven years, Roth said that Musk was facing a huge challenge to achieve his free speech vision. Roth warned his former boss that advertisers, which he “neither controls nor has managed to win over,” would pose a clear threat to his revenue stream if they were spooked by the site’s direction. And even if he found another way to make money, regulators in the United States, Europe and India were also wary, threatening Twitter with big fines or government interference if the platform fails to play by the rules. But most of all, Roth said it will be the app stores run by Apple and Google’s Android that hold the greatest sway over the future of Twitter. “Failure to adhere to Apple and Google’s guidelines would be catastrophic,” Roth warned. Adam Frisch, a businessman and former city councilman in Aspen, Colorado, said he had called Boebert and conceded the contest, which appears destined for an automatic recount with Boebert leading by fewer than 600 votes out of more than 325,000 cast in the Nov. 8 midterm election. “The likelihood of this recount changing more than a handful of votes is very small,” Frisch said in a news conference streamed on his Facebook page, adding that he did not want to raise money from supporters for an effort that would not succeed. Republicans this week were projected to have won a narrow majority in the U.S. House, setting the stage for two years of divided government with Democrats still in control of the Senate. House Republicans will be able to block much of Democratic President Joe Biden’s agenda. Boebert’s victory gives Republicans 219 seats compared to 212 for Democrats, according to Edison Research, with four races still too close to call. Lynch WASHINGTON (Reuters) – U.S. Attorney General Merrick Garland on Friday named Jack Smith, a war crimes prosecutor, to serve as special counsel to oversee Justice Department investigations tied to Donald Trump involving the former president’s handling of sensitive documents and efforts to overturn the 2020 presidential election. Garland’s announcement came three days after Trump, a Republican, announced he would run for president again in 2024. Garland said Trump’s candidacy, as well as Democratic President Biden’s stated intention to run for re-election, made the appointment of a special counsel necessary. Special counsels are sometimes appointed to investigate politically sensitive cases and they do their jobs with a degree of independence from the Justice Department leadership. “The pace of the investigations will not pause or flag under my watch,” Smith said in a statement. “I will exercise independent judgment and will move the investigations forward expeditiously and thoroughly to whatever outcome the facts and the law dictate.” Smith will oversee the investigation into Trump’s handling of government documents after leaving the White House last year and the probe into attempts to interfere with the peaceful transfer of power following the 2020 election, Garland said. “Appointing a special counsel at this time is the right thing to do,” Garland said at a news conference. Trump, in a statement to Fox News, said he “won’t partake” in the special counsel’s investigations. “For six years I have been going through this, and I am not going to go through it anymore,” Trump said. Biden, who appointed Garland, did not respond to shouted questions from reporters about the special counsel during his only public appearance of the day. The White House was not involved in the decision to appoint Smith, an official said, speaking on condition of anonymity. This marks the second time in the span of five years that the Justice Department has appointed a special counsel to probe Trump’s conduct. Former FBI director Robert Mueller, appointed as a special counsel in 2017, documented contacts between Trump’s 2016 presidential campaign and Russia, but found insufficient evidence to bring a charge of criminal conspiracy. Smith’s appointment was made at a time when FBI agents across the country have faced threats in the aftermath of the law enforcement agency’s seizure of thousands of government records, some marked as highly classified, during a court-approved Aug. 8 search of Trump’s Florida estate. The search was part of a criminal investigation that Trump has called politically motivated witch hunt. Investigators also are examining Trump for possible obstruction of the probe. Trump filed a civil lawsuit in an effort to delay the documents investigation and keep some records from investigators, claiming they are privileged. The other investigation is a sprawling probe into a failed plot by Trump’s allies to overturn the 2020 presidential election by submitting batches of phony slates of electors to the U.S. National Archives and trying to block Congress from certifying Biden’s election victory. A grand jury is hearing evidence in that case, with prosecutors issuing subpoenas for testimony to top former White House attorneys and close advisers to Vice President Mike Pence. While Garland ultimately has authority over the special counsel, the appointment of an independent third party will allow Garland to create some political distance that could bolster public confidence in the integrity of the two investigations. Career prosecutors are expected to continue working on the two investigations alongside Smith. Smith, a political independent, until recently served as the chief prosecutor for the special court in The Hague, tasked with prosecuting war crimes in Kosovo. He previously oversaw the Justice Department’s public integrity section and worked as a federal and state prosecutor in New York. Smith recently underwent surgery after injuring a knee in a biking accident. He did not attend the news conference. The dramatic move sets up the prospect of a drawn-out legal battle, with Trump likely to claim he is being targeted by the administration of Joe Biden to prevent him winning back the presidency. At a press conference, Attorney General Merrick Garland announced the appointment of Jack Smith, until recently a chief prosecutor in The Hague charged with probing Kosovo war crimes, to take over the two ongoing federal investigations into Trump. One is focused on the former president’s efforts to overturn the results of the 2020 election and the January 6, 2021 attack on the US Capitol by his supporters. The other is an investigation into a cache of classified government documents seized in an FBI raid on Trump’s Mar-a-Lago residence in Florida in August. Garland said naming a special counsel was in the public interest because both the Republican Trump and his Democratic successor Biden have stated their intention to run in 2024 — although only Trump has officially declared for now. “Appointing a special counsel at this time is the right thing to do,” Garland said. “Such an appointment underscores the department’s commitment to both independence and accountability in particularly sensitive matters. “The extraordinary circumstances presented here demand it,” he said, adding that Smith was the “right choice to complete these matters in an even-handed and urgent manner.” In a statement, Smith, who previously headed the Justice Department’s Public Integrity section, said he would conduct his investigation “independently and in the best traditions of the Department of Justice.” “The pace of the investigations will not pause or flag under my watch,” he said. “I will exercise independent judgement and will move the investigations forward expeditiously and thoroughly to whatever outcome the facts and the law dictate.” Delicate matter Trump’s entry into the White House race on Tuesday makes indicting him a much more delicate matter. The appointment of an independent prosecutor to oversee the twin investigations could serve to help insulate Garland, a Biden appointee, from charges that the probe is politically motivated. The special counsel will determine whether the former president — who says he is a victim of political persecution — should face any charges in connection with either investigation. The special counsel would still report to the attorney general, who would have the ultimate say on whether charges should be brought. Even if charged, the 76-year-old Trump can still run for president — nothing in US law bars a person charged with or convicted of a crime from doing so. While in office, Trump was investigated by special counsel Robert Mueller over obstruction of justice and possible 2016 election collusion with Russia but no charges were brought against him. In addition to the federal investigations, Trump faces other legal woes. New York state’s attorney general Letitia James has filed a civil suit against Trump and three of his children, accusing them of business fraud. And Trump is being investigated for pressuring officials in the southern swing state of Georgia to overturn Biden’s 2020 victory — including a now-infamous taped phone call in which he asked the secretary of state to “find” enough votes to reverse the result. Trump’s unusually early announcement that he was running for president in 2024 was seen by some analysts in Washington as an attempt to stave off potential criminal charges. The lawsuit, filed in Amarillo, Texas, federal court by the Alliance for Hippocratic Medicine, American Association of Pro-Life Obstetricians and Gynecologists and others, said the U.S. Food and Drug Administration lacked authority to approve the drug for abortion when it did so in 2000 and that it failed to study its risks for minors adequately. The FDA “failed America’s women and girls when it chose politics over science and approved chemical abortion drugs for use in the United States,” the lawsuit said. The FDA did not immediately respond to a request for comment. President Joe Biden’s administration earlier this year moved to expand access to medication abortion after the U.S. Supreme Court in June overturned its landmark 1973 Roe v. Wade decision guaranteeing abortion rights nationwide. Mifepristone is a prescription drug approved by the FDA to induce an abortion up to 10 weeks into a pregnancy. It must be followed by a second drug, misoprostol. Both drugs also have other uses. The plaintiffs in Friday’s lawsuit said the FDA improperly approved mifepristone for abortion in 2000 under an expedited process intended to allow patients quicker access to better treatments for an illness, even though pregnancy is not an illness, and waived a requirement to study it separately for pediatric patients. The Supreme Court’s June ruling put a spotlight on medication abortion, which accounts for more than half of U.S. abortions. A Dutch supplier of abortion pills by mail saw demand surge in the wake of the decision, which has allowed more than 20 states to begin enforcing new restrictions on abortion.
