Does anyone know how masseurs protect themselves legally and what's the worst that could happen if they got discovered?

 

The obvious is to:

 

Be licensed

Conduct massage business in accordance with state license standards

Pay taxes

 

I suspect that’s not the answer you’re really looking for though.

Essentially I'm wondering how risky it is to offer extras to clients in the private of their home. Not knowing much about the law is it safe to assume once the massage begins if both parties agree on something it's okay, or still risky if someone found out what the masseur was offering? How do they not worry about cops posing and texting them asking them what they offer?

Most of us can't speak to the laws that are in effect in your jurisdiction.

 

The internet is a wonderful place. You'll probably find that all the laws that apply to you are online. If not, wouldn't a consultation with a lawyer, especially a Gay friendly lawyer be beneficial?

 

Here's some starting points that would be useful:

  • Does your jurisdiction have a "Consenting Adults" law?
  • What is the law that effects masseurs?
  • Do you charge for your time or for what you do?

The answer to your question is: "Fines and/or Jail time, most likely probation."

If you are suggesting the masseur is offering something illegal, I should think there is inherently some risk in that. How much risk? Hard to know. But I have a philosophical question for you: if a tree falls in the forest and there is no one around at the time, how do you prove (beyond a reasonable doubt) that it made a noise? Thanks. I guess my question came up as I've been in LA for a few years now and have never heard of any masseurs getting busted (other than sexual assault claims at spas, Asian places with stings, etc.). I'm just curious how all of these guys are able to protect themselves.

I spoke with my masseur and he offered the following:

 

1) Law enforcement does not have the time or resources to go after individual masseurs/masseuses who might be offering illegal services.

 

2) Law enforcement instead tends to focus on massage parlors with masseurs/masseuses who might be offering illegal services. They then bust the whole place and shut it down. That makes sense since why spend money/resources one by one...when you can bust a large amount of people at once. That is why we never see a news headline such as "Jerry Smith Busted In Massage Raid" But I myself have seen news headlines such as "Happy Day Asian Spa Busted In Raid"

 

With that being said, it is really sad that this even needs to be discussed. As we know, erotic massage or escorting are victimless crimes. To have a crime, there must be a victim. That is the definition of a crime.If someone steals your car, there is a crime, since there is a victim....the owner of the car. In erotic massage/escorting there are no victims. Both parties agree to the arrangement. Both get what they want. No victims=no crime. What a waste of taxpayers dollars. But mark my words, one day, hopefully in our lifetime....erotic massage/escorting will be legal. It is already legal in many countries. The United States just needs to catch up. (like we did with gay marriage)

Just to complicate things a bit more:

 

If you’re operating out of your home you may also need a small business license and comply with appropriate zoning laws. Also likely subject to health inspections. There may be other State, County and City codes to comply with.

 

I’m not trying to throw a wrench into your possible plans - but you did say “protect themselves legally” in your initial post. I just want you to be aware of the issues that may be involved to do that.
