Calif. Supreme Court Invalidates Gay Marriages

The California Supreme Court today invalidated all the gay marriages performed in San Francisco earlier this year.

 

The Court did not address the issue of equity or rights.

It decided only that the mayor (Newsom) had overstepped his authority in superseding state law.

It appears that the CA Supreme Court left open the possibility of a constitutional challenge to the state's marriage laws. That's the issue in a separate case that's working its way through the system. It's not over yet in California, unless it, too, passes a constitutional amendment. At that point it'll be up the U.S. Supreme Court (in Antonin Scalia's nightmare scenario) to decide if we have equal rights under the U.S. Constitution. The Supreme Court will also have to decide on the recognition of same-sex marriages in all of the states, as it had to do in the case of mixed-race marriages.
