CANADA: Prostitution and the Law

Most of those laws seem to make sense except:

Canada's 1993 'kiddie' porn law makes it illegal to make or own pictures (photos, film, videos, magazine pictures) of anyone who is, or looks like they are, under 18 having sex.

Once you turn 18, it's not against the law for you to be in sexy pictures, films or videos, as long as they do not break the obscenity law and you don't look like you're under 18.

What kind of standards does one set to decide whether a 19 year-old "looks like" he's under 18?? By the way, those pictures of His Imperial and Royal Highness Prince Amadeo of Belgium, Archduke of Austria-Este, that a lot of you were ogling over were of a 19 year-old (he's turning 20 in less than two weeks).

Actually the information is imprecise and not current. I don't know when that booklet was written but things have changed quite a bit lately. I am not a lawyer b ut have been consulting one for a while, and have been reading current stuff about the subject. This is my personal take on things:

 

Anal sex has been decryminalized on the basis that it was a discriminatory measure, because it would leave gay men without any possibility for intercourse... :o I am pretty sure that it is not a cryme anymore.

 

Also, that site says that selling sex for money is okay. I think the writer is not talking about the actual law, but the way in which the law is applied. They have put a lot of care in the wording of the laws, and in this case, sex for money is NOT allowed. Escorts are just allowed to sell their time of companionship.

This is really important because this law is thought to give the escort the final choice. The escort can choose to not engage in any sexual act that he/she doesn't want to engage in, and the client will still be obliged to pay for his time. That way no escort will (theoretically) be forced to do anything he/she doesn't want to.)

 

Also... (but I am not sure about that) I believe that any act of prostitution under 18 is illegal. I think that since the writer of that booklet talks about the fact that after you are 16 you cannot be arrested while working the streets, it gives the false impression that being a prostitute under 18 is okay. I am almost sure it is not. I think this booklet is adressing the escort-to-be, not the law about escorting.

 

I often think about the slippery slope thing when I read about laws about sexuality all around the world. They are so different and they depend so much on culture, religion, history, and customs of every particular country.

 

I really hope that all around the world, We as a race will keep talking about sexuality, sexual laws, age of consent, child protection and embracing of diversity. That to me is one of the most important signs of the fact that a culture has reached (or is close to reaching) adulthood.

I think that refers to young looking people trying to exploit the teenager look.

 

What I read about that is that nobody "appearing to be younger than 18" should be in sexually explicit depictions because that would promote or sexualize the image of an underage person.

 

It sounds rigorous to me... but when it comes to sexual exploitation of children (or children's images) Canada is very strict. Gotta love'em canadians, heh!
