As of Friday, the Autauga County Probate Office ceased all marriages inside the office. Probate Judge Al Booth told the Montgomery Advertiser newspaper that the decision to stop performing the ceremonies was related to work flow, not the recent federal court order lifting the state’s ban on same-sex marriages.

Autauga County Sheriff Joe Sedinger tells ABC News that Diprizio's attempt to perform a marriage was the only reason she was arrested for disorderly conduct and not with the fact it was a same-sex marriage.

The actual news is that since the only defendant in the case being litigated is the Attorney General, the governor and many of the probate judges entrusted with the responsibility for issuing marriage licenses have decided to flout the judge's order either by refusing to issue licenses to same-sex couples or by refusing to issue licenses at all. Because they are not parties to the litigation, this was not contempt of court.

 

As I understand it, the judge in the case is being asked to order the Mobile probate judge to issue licenses in accordance with her decision, presumably as a test case. I can't imagine any reason why she wouldn't do so, and if she does, the other probate judges know they need to fall in line or they'll be next. Refusing to issue licenses at all is no less suspect; for one thing, as it's a vital state function, they're shirking their legal responsibilities by not doing so. Besides, it's obvious they're doing it to avoid compliance.

Following up on my last post, the Federal judge ordered the Mobile County probate judge to begin issuing marriage licenses:

Other probate judges who don't do so may face similar lawsuits.

 

Also, the Chief Justice of the Alabama Supreme Court quoted in the article is the same jackass who refused to obey a court order to remove a display of the Ten Commandments.
