Yes means yes law.

 

Gov. Jerry Brown has signed a bill into law that makes California the first in the nation to have a clear definition of when people agree to sex. The law goes further than the common "no means no" standard, which has been blamed for bringing ambiguity into investigations of sexual assault cases.

 

The new law seeks both to improve how universities handle rape and sexual assault accusations and to clarify the standards, requiring an "affirmative consent" and stating that consent can't be given if someone is asleep or incapacitated by drugs or alcohol.

Similar law exist in Spain where a man accused of rape has to prove he didn't rape a woman, at the same time if a woman lies about having been raped like it happened in Duke University he could be going to jail for a year. Judges in Spain are educated people who know rape could result in pregnancy, unlike so many Americans who believe in the theory of the magic uterus closing itself to unwanted sperm.

 

maybe it should be applied to this kind of situations too.

Absolutely brilliant post Marylander. Not much of a Gov. Brown advocate, but I will say that this time around, he is doing a fairly good job, considering what he inherited. And the video is very powerful. We rarely hear about men being raped.
