So I am not a resident than, because I cannot vote, i dont pay taxes etc? I am just here in an extended visitors visa... your thoughts?

David--I think you are missing the point. You don't' pay taxes here simply because you "choose" not to--you don't pay taxes in Canada either (do you?).

 

You HAVE TAKEN A JOB and it appears that you areLIVNG HERE WITH THE INTENT TO STAY indefinately--that is the real test for residency--what is your INTENT?

 

Intent is proven through not only your statement of your intent, but more important, your actions from which the law can draw reasonable deductions and conclusions--the better and stronger evidence.

 

If you paid taxes in Canada and voted in Canada, and could prove an intent to return to Canada, and not living here in violation of any visa or immigration laws, that would be one thing. But you don't vote here cause you evidently choose not to. Same with taxes, and more importantly, you don't pay taxes or vote anywhere else either (My assumption--right or wrong?)

 

You are unable to show any reason for your "temporary" stay, such as just here for school or a temporary, "on location" job that has a defined terminus and then you return. You are simply living here, working here, making money here, eating here, paying rent here, driving a car here (illegally) and therefore using the highway system paid for by taxpayers of the state or USA, and your stated intent IS TO STAY here--therefore, it would appear you are a resident and I'd bet money that any jury or judge would find you so--which means that the VC statute cited by deej APPLIES to you--AND, when you apply for a Ca driver's license (and maybe even the official ID, but not sure) you are required to SURRENDER ALL OTHER DRIVERS LICENSES so that driving here is only under California DL IF you are living here more than 10 days.

 

So, that's what I think--just telling you what the probable finding would be if tested, not being judgmental :+

well Flower, good advice, I mean ive just never had to deal with these issues before. I kinda got pushed into having to deal with life situations like these and before it was never even an issue.. so Im learning. I just need to get the car from my mom becasue than I can take care of business down here IE tickets and what not.

 

But to vote.. dont i need to be a US citizen? and i KNOW thats almost impossible to come by lol
